Hi, Steve, Julie, and All,

I found out that there were different regulations if the space to be rented
was in a building which is also occupied by the owner and which has only a
few rented rooms when I was looking for a place to live off campus when I
went to grad school in the Boston area.  Many times when I responded to ads
for rooms to rent near the campus, I was able to make an appointment to see
the room.  But after visiting, with or without the guide dog, I would often
be told that the room had been previously promised to someone else.  My
suspicions were however aroused by little comments such as, "The room is
upstairs, you know.) which indicated a complete ignorance of the
capabilities of blind persons.  So I think the issue was more often
blindness than the presence of the guide dog.  Even though these rental
properties were on the list which the college kept and provided to students
who were seeking housing, the college officials said there was nothing they
could do about this type of discrimination in properties with less than 4 or
5 units and where the owner was resident in the building.

It would be interesting to see the exact wording of any such regulations,
and also to know whether there are differences between shortterm stays such
as at the B&B's and longer term rentals such as the college housing
situation.  I could understand if the B&B's were under the ADA public
accommodations section, while the college housing situation was under the
FHA or.

Steve,

there's an exception when the owner lives in the same building and there are
a very small number of rooms to be rented.  It would be the same thing if I
wanted to rent out my guest room.  I wouldn't be obligated to allow a
service dog with it's handler if I didn't want to.

They are still subject to the provisions found under ADA Title III, Places
of Public Accommodation.

I wonder where a Bed And Breakfast place would be treated under the ADA?

Anne, I would do the same thing if i stayed in a B&B and was bringing my
guide dog.  I never stayed at one but many times they are owned and run by
people who also live there.  So, yeah, I personally would talk to the owner
before going there to make sure all is well.  To me doing this could be the
difference in having a pleasant time or a tense one which nobody needs.

Did you get to see the Lab's puppies while at that B&B?  I bet they were
sooooo cute!
