Marion, thank you, this is the type info I need. I would greatly appreciate
hearing your legal counsel's opinion on this subject. I will eagerly await
the response.
Sincerely,
Ken & Ace

STEVE,
I'm not sure this is correct. It is my understanding that FHA
applies to the residential areas of housing, whereas the common areas are
governed by the ADA. A service animal under FHA is allowed access only in
the residence and the direct path to it. Service animals, as defined by the
ADA are allowed in any place others are invited, such as the pool, fitness
center, club house, etc. I will be speaking with our legal counsel on
Tuesday concerning the airlines and a cruise issue, so I will try to
remember to ask her this question.
Fraternally yours,
Marion Gwizdala

Ken, it wouldn't be an ADA issue, but rather a Fair Housing issue if you are
talking your condo. Unless, the swimming pool is open to the general
public, you need to look at fair housing law instead. Which in that case, I
would be consulting with the condo association first to see if there is
anything in writing that either supports or denies this.

I question your " access laws are for people" as I mentioned he is allowed
to stay in my hospital room with me and every place I go like on the beach
where dogs are restricted. My purpose of this inquiry is to get
clarification on ADA and not personal opinions. Most people I know with
pools and Labs have them in their pools all the time and that includes my
vet and what is wrong with "Play Time"?
Thanks,
Ken & Ace

Dear Ken,
Access laws apply to peo9ple not dogs; you can take him there, but I
suspect that if they don't want the dog in the pool, especially if residents
claim allergies, you won't have much to go on; besides, why would you put
your dog in highly chlorinated water?
Curiously, Darla

Thanks for the reply. Ace gets shaved once a month, groomed once a week and
brushed in between so I am not too concerned about the filter and I would
think ADA would trump any local ordinances but I just can't find a ADA
ruling on the subject.
Thanks again,
Ken & Ace

Hi Ken,
So long as it is cool enough, I don't know why you shouldn't take
him so long as people don't bother him or he bother anyone else.
If you're asking about actually allowing him to swim with you, I'm
not sure there is a law that applies, but it will tend to clog up the pool
filter and thus not make the HOA very happy. <grin> Darla & Huck

I recently attended a continuing education class to maintain my LCAM
license. During the class the question came up about Guide Dogs in condo
settings and access to swimming pools.
The answer was that in most cases Guide Dogs should be thought of as being
invisible as they were allowed anywhere their owner was.
I know that my Guide Dog has stayed in my hospital room with me on several
occasions and is allowed anywhere but the OR.
I would love to swim in our condo pool but only with my dog as I don't feel
comfortable without him.
Do you have any information in this regard? I have tried to Google it for an
answer, and it may be my limited computer skills but I can't find an answer.
Do have any info on this?
Ken & Ace
