Judge dismisses Blue Ash mini service horse suit

A woman has lost her fight with the city to keep a miniature horse, used as
a service animal for her daughter, on her Blue Ash property. 

 

A federal judge dismissed Ingrid Anderson's lawsuit against the city, but
Anderson can still file an appeal. 

 

Anderson, along with Housing Opportunities Made Equal (HOME) filed the
lawsuit in February after the City of Blue Ash classified the horse as a
farm animal and claimed it violated zoning laws.

 

The horse, named Ellie, is used by Anderson's 13-year-old daughter with
disabilities. Anderson says Ellie helps her daughter to walk and live as
normal a life as possible. 

 

Anderson, who had been fighting the city for years before taking the issue
to court, claimed the mini horse was a service animal and therefore was
protected under federal law.

 

The city maintained the animals use had not been proven. Officials said they
received multiple complaints about the smells, noises and animal waste at
Anderson's property. 

 

It is currently unclear whether or not Anderson will seek an appeal in the
case.
