Remember also that the proprietor, under the ADA, can ask if the dog is a
service dog as well as what service the dog performs. You should consider
helping the business people feel empowered to determine if or if not the dog
truly performs a function.

Also, you can help the business owners feel empowered to tell the person to
remove their dog if it misbehaves.

It's not a fake service animal. Animals don't fake it, people do. If the
woman has a disability, then the dog if trained to do a task to mitigate her
disability, is a service animal. It sounds as if the dog is poorly trained
though. that is a different issue. Businesses can ask her to take the dog
out, if it's acting inappropriately, touching other customers uninvited,
touching the merchandise, barking, or other ill behavior. However they do
have to give her the opportunity to address the situation. One bark or
sniff isn't grounds for an eviction, but repeated behavior that isn't
addressed is grounds for the boot.

Subject: [nagdu] Fake Service Dogs

Hello, In the last week I have been approached by two different individuals
at different times about a woman in town who has PTSD and has a service dog.
Their claims are that it is a fake service animal because of the way it acts
in public. It is a great dane and I have seen it in public before and I
would tend to agree.

I would appreciate any suggestions on how to address this matter?

Miranda
