You are correct the ADA doesn't consider emotional support animals to be
service animals.  The ADA only says that folks with service animals *must*
be allowed in any place where the public is normally allowed.  The ADA says
nothing about excluding pets or  emotional support animals  from these same
places.

The only places that are regulated regarding entry of animals are health 
care establishments and food preparation establishments.   There might be 
some others, but none are coming to mind at the moment.  anyway if I want to
open up a shoe store and put a "pets welcome" sign on the front door, it's 
totally legal and entirely my prerogative as a business owner.   A lot of 
home improvement/hardware type of stores allow well behaved pets, as do some
restaurants in the outdoor seating area and some clothing stores.  Here in
my town I can think of three stores off the top of my head that have pets in
the store, the florist, the computer repair and the lawn care place.  Oh and
the animal shelter has a greeter dog on staff.  I forgot about him.

So if a college wants to allow pets or ESA's on campus they are entirely
within their right to do so.  Or at least that is how I understand the laws.

Well, I could be wrong about this, and I likely am, but it's my
understanding that the ADA doesn't consider emotional support animals to be
service animals in the legal sense.  If that's the case, can they really do
that?

Hi all.
The university I attend is passing a policy that allows emotional support
animals to be living in on campus housing.
The only reason I am not thrilled with this change is because we as a
university have had no less than five dog fights on campus in the last year
alone. All of these fights have been between a service dog and an esa.
What do you guys think of this?
