From: Dennis Russak, Good Morning everyone,

I read with great interest Lisa Irving's entry about the job offer from an Agency for the Blind in San Diego about the part time Recreation coordinator.

From what I understand about the Americans with Disabilities Act, as long as you can come up with an alternative technique in performing that part of the job that the agency says supposedly requires driving, then the driving requirement may be illegal according to the ADA. However, the ADA. has been through the courts so many times, I couldn't even try to tell you much about it anymore.

I would contact either Shannon Dillon, Tim Elder, or Scott LaBarre further about this matter. They are three Federation attorneys who know the law and can give you a better and more educated opinion about it. In my opinion, though, this agency may not have the best posative beliefs about blindness. I've dealt with these type agencies before when I lived back east, and they leave a lot to be desired. (For this agency's information, a blind person could (1) hire a driver at his/her own expense to drive the perspective employee when required, or (2) the agency in question could pay such a driver).

So, Lisa, I would contact the people I suggested about this, because in my opinion, if it truly is illegal, that agency down there should know better than this, and shouldn't be allowed to get away with this.

    Dennis Russak
