RE: Order of Selection Priority Category Changes

The Rehabilitation Act, as amended, requires agencies to prioritize
categories within the eligibility process

in the event of a shortage of fiscal or personnel resources.  Under the
federal law, states must assure Order of Selection criteria where
individuals with the most significant disabilities are selected first for
the provision of vocational rehabilitation services.

Upon submission of the Kentucky state plan, the Rehabilitation Services
Administration (RSA) informed the

Kentucky Office of Vocational Rehabilitation (OVR) that the way Kentucky
defines priority categories does not comply with the federal regulations.
Specifically, they referenced the Most Significant Disability (MSD)
category because it distinguishes the need

for long-term support services as criteria. RSA stated that services needed
cannot be used as criteria for priority category assignment.  OVR sought
technical assistance from RSA and proposes the following changes to the
definition of MSD and priority categories:

1 - Most significant disability with limitations in three or more
functional capacities

2 - Most significant disability with limitations in two functional
capacities

3 - Significant disability with limitation in one functional capacity

4 - Non-significant disability

OVR has scheduled two virtual public hearings in August to give consumers
and other interested individuals

an opportunity to comment on proposed changes to the Order of Selection of
consumers for services.  Virtual public hearings are scheduled for the
following dates and times:
