Dear Mr. Harcz:

 

This notice is in response to your March 26, 2011 email (attached) request for copies of nonexempt public records/information under the state's Freedom of Information Act (FOIA), MCL 15.231 et seq., you describe as ".all email correspondences between the period of January 1, 2011 and March 24, 2011 and Patrick D. Cannon (MCB Director) or his Administrative Assistant, Susan Luzenski and former MCB Commissioner, gerri Taeckens."

 

Please be informed that your request, pursuant to MCL 15.235, Section 5(2)(c) of the FOIA, is partially granted and partially denied.

 

As regards the granted portion of your request, after a search for records, to the best of the Department's knowledge, information, and belief, the Department has found all email records in its' possession responsive to your request. However, based on the estimated labor time involved in processing this request, the Department, per MCL 15.234, Section 4(3) of the FOIA, has assessed estimated costs of $97.92. In this particular instance, failure to charge processing costs would cause the Department to incur unreasonably high costs that exceed the normal required activities to search for and examine/review the requested records to delete/separate exempt from nonexempt information. 

 

As regards the denied portion of your request, a cursory review of the records/information requested indicates that certain exempt, confidential information may need to be redacted before disclosure can be made.

 

 

The estimated cost of $97.92 is based on the following estimated labor costs calculations of the hourly wage (including benefits) of the Department's lowest paid employee capable of retrieving and examining the information necessary to comply with your request under this state's FOIA:

--Human Resources Analyst 9-12 @$32.64/hr X 3hrs=$97.92 (search for and redaction of exempt information)

 

Upon receipt of payment of the $97.92, the Department will continue processing this request; send you nonexempt records responsive to your request; notify you of any claimed exemptions to disclosure; and notify you of any balance of costs you may owe, or reimbursement owed you.
