How come I could get an entire college, and in other complaints the entire City of Manchester N.H. and N.H. Vocational rehabilitation agencies to fully comply with signage and other ADA requirements (see just one attached complaint) and yet to this date there are very few if any State Agencies that fully comply or even come close (re: DTMB surveys() that I've sent you both?)

These issues and the issues of effective communications especially the lack thereof have been noted and documented over now close to a decade by me to you all at M PAS.

When are you going to do your due diligence and ensure full accessability by this scofflaw entity?

Dear Mr. Harcz:

This letter is to notify you that, effective the date of this letter, the Office for Civil Rights (OCR) is closing the monitoring of the above-referenced complaint filed against Notre Dame College (College). Our decision is based on progress reports provided by the College, and the April 30, 2001 letter submitted by Dr. Alicia Finn, the College’s Vice President for Student Development.

As you are aware, on September 4, 2000, the College signed a Resolution Agreement to address the issues and concerns identified as a result of OCR’s investigation of the complaint. Pursuant to the Agreement, the College committed to take the following corrective actions: 1) develop a written policy regarding access to reader services; 2) modify the unisex restroom located on the first floor of the Library; and 3) identify accessible routes and install appropriate signage on campus. Furthermore, as a result of a subsequent complaint filed against the College, an addendum was added to the Agreement on March 2, 2001.

In her April 30th letter, Dr. Finn informed OCR that the College has completed the corrective actions specified in the Agreement. She also provided OCR with a videotape documenting the completion of these projects.

Based on our review of the progress reports, the April 30th letter and the videotape, evidencing the completion of the work, OCR has determined that the College has satisfied the terms of the Agreement. Therefore, effective the date of this letter, OCR will close the monitoring phase of this complaint and will take no further action in this matter.

In your previous communications with OCR, you raised concerns regarding the lack of signage at the College’s Physical Therapy facility. As a result of our on-site visit and the information provided by the College, OCR has determined that the Physical Therapy facility, which is presently located in the Rhines Center, is equipped with the requisite signage.

Thank you for your patience and cooperation in this matter. If you have any questions, please contact Equal Opportunity Specialist Andrew Stith at (617) 223-9681 or me at (617) 223-9683.

                                                            Sincerely,

                                                            Carolyn F. Lazaris
