Dear Mr. Harcz:

 

This notice is in response to your March 2, 2012 email to me regarding your request for copies of existing, nonexempt public records under the state's Freedom of Information Act (FOIA), MCL 15.231 et seq., you describe in the attached as:

 

".the personnel within the Michigan Department of Licensing and Regulatory Affairs who were

responsible for writing the LARA components relative to Governor Snyder's Executive Order 

relating to the unilateral abolishment of powers and duties delegated under the Rehabilitation Act 

of 1973 and of Public Act 260. In other words who was the responsible party or "architect" of this? 

Was it Deputy Director Steve Arwood?

 

Please be informed that, pursuant to MCL 15.233, Section 3(1) of the state's FOIA, your request is denied as the request does not sufficiently describe a public record to enable the Department to find it. Your request is for an answer to a question. The purpose of the state's FOIA is to provide the public with access to existing, nonexempt public records of public bodies. It is not the purpose of the state's FOIA to permit persons to secure from public bodies, answers to questions that incidentally may be reduced to a writing as that is defined under MCL 15.232, Sect 2(h) of the state's FOIA.

 

However, in the spirit of cooperation and assistance, any Executive Order by the Governor involving components of this Department would be coordinated with/through the Department's Director and his/her executive office staff.

 

Pursuant to MCL 15.240 of the FOIA, you may, (1), submit a written appeal regarding the denial of any portion of your FOIA request to Steven H. Hilfinger, Director, Michigan Department of Licensing and Regulatory Affairs, Attention: Mike Zimmer, Chief Deputy Director, Ottawa Building, 4th Floor, P.O. Box 30004, Lansing, MI 48909. Your written appeal must include the word "appeal" and identify the reason(s) for reversal of the denial(s); or (2), you may seek judicial review within 180 days of the Department's final determination. If you prevail in court action, the court may award reasonable attorney fee, costs, and disbursements. If the court finds the Department's action(s) to be arbitrary and capricious, the court shall, in addition to any actual compensatory damages, award punitive damages in the amount of $500.00.

? Dear Sir and Madame,

 

I am writing today to inquire pursuant to the Michigan Freedom of Information Act the personnel within the Michigan Department of Licensing and Regulatory Affairs who were responsible for writing the LARA component relative to Governor Snyder's Executive Order relating to the unilateral abolishment of powers and duties delegated under the Rehabilitation Act of 1973 and of Public Act 260.
