Dear Mr. Zelley,,

 

I have several questions regarding the quoted items from the following 704 report of the Disability Network:

 

 

RSA704 Part II for The Disability Network - H132A010051 report through September

September 30, 2008

 

 

 

 

 

 

“· TDN provides equal access and necessary accommodations such as sign language interpretation, assisted listening devices, language line and information

in alternate formats to ensure TDN services and facilities meet the needs of individuals with disabilities. In addition, TDN utilizes an accessible community

….”

 

 

And this section:

 

 

“o TDN is in the process of some minor redecorating and remodeling the office. A TDN accessibility survey is being completed to assure changes are in line

with ADA standards.”

 

 

 

 

Now as per the first contention that you supply all information in accessible formats especially to this blind man to whom you even recently have not even responded to requests is a lie and a documented lie at that. Moreover, you have made false statements, again documented to a Federal investigative agency in this very report which is a violation of the false statements act.

 

Now, how can you make these assertions for TDN when they simply weren’t true in 2008 and are not now and  thus are in stark violation of Section 504 and of the Americans with Disabilities Act?

 

On the second matter I am requesting the self-evaluation that you reference in the 704 report concerning ADA compliance at TDN’s Dort Highway facility in accessible format. Please send me the afore mentioned document (along with previously requested ADA surveys conducted by TDN) as Word documents or as plain text enclosures to my e-mail adress listed above. I, of course make these continued requests pursuant to your federally funded Center for Independent Living responsibilities under both Title III (auxiliary aids and services) responsibilities and likewise for TDN’s obligations under Section 504 of the very Rehabilitation Act of 1973 which is responsible for your CIL to begin with.

 

A failure to timely respond to these requests for information is actionable and these are civil rights violations Mr. Zelley,
