All,

Twenty four years after the ADA and forty years after 504 I, Paul Joseph Harcz, Jr. doesn't have access in a timely manner to his own records and files related to his own medical care and the system. Moreover, I am forced to make all of this public as the system doesn't make anything accessible to me in the first instant.

In short everyone has some snapshot of my personal information but me. Now what kind of screwed up system is this? And how am I protected under HIPPA let alone how am I afforded the rights, benefits and activities afforded by federally funded programs as afforded by HIPPA and other laws; indeed here I have to make this public to expose the abuse for example? I am not and moreover I'm forced, forced mind you to go public with this systemic abuse and that puts me in even more harms way vis a vis public exposure and retaliation.
This system is perverse, discriminatory and heads should roll.

Note herein is on who is the so-called State of Michigan ADA Compliance officer, one Sharon Alston Ellis whom amongst other things has been a participant with discriminating against me personally in documented format and whom has oversight of the thousands of documents on the State of Michigan web site that are not accessible to this day including the "MI Bridge" application and well that which is self evident and documented need not be explained.

It is long since time for class action lawsuits on multiple applications along with acts of civil disobedience and anything necessary and legal to make our state actors comply with long standing civil rights laws.

And if it means blind and otherwise disabled people calling for de-funding, or punitive suits or even blockaging and disrupting our state actors who steal and abuse from us then so be it!

  Hi Ms. Nichols,

  The correspondence that was sent to Mr. Harcz was his Health Care Determination Notice.  Once his redetermination was processed, a notice was automatically generated and mailed to him.  As previously discussed, there will be times when forms are automatically generated but when that occurs, they will be followed up with an email that converts the form in plain text that Mr. Harcz can read. The correspondence informs him that his eligibility for the medical savings plan which pays for his Part B premium will continue.  The notice also informs him of that he remains ineligible for full Medicaid due to excess income; he remains having a $756.00 dollar deductible case.  I have attached this form in .pdf format for your review and in plain text format for Mr. Harcz review.  If either of you have any questions after reading the forms, please feel free to contact me.  



  Please correct me if I’m wrong but I believe the additional information that you requested following our July meeting is the asset information that we received from the financial institution. The caseworker, Ms. Cochran, was unexpectedly called out of the office but is expected to return next week.  Upon her return, I will be sure to forward that document to you.  Because his financial institution sent it to us as a hard copy document, I will not be able to convert it to plain text.    Alternatively, I will write out in an email what the document stated so that he can get a summary of the contents of the form.  I will also scan and email it to you.  If there are other documents that you need, please feel free to let me know.

  Dear Mr. Savoie:  Unfortunately my client tells me that once again he has received something in print in the mail that his elderly father tells him is from DHS, which my client cannot read because he is blind.  I thought we had worked out in our personal meeting with yourself, Supervisor Romanetto, and my client and I on July 21 that this would not occur again.  This appears to be another violation of my client’s rights under the ADA as well as the accommodation we negotiated with DHS’s ADA office last fall.  

  Can you please provide the communication to me and my client in a Word or text-based attachment or in the body text of an email?  Was the communication the completed redetermination that you agreed to provide me with below, following our July meeting?  Thank you.

  Today was the due date for the verification of bank account to come in.  We are waiting to see if it comes through the mail.  If it is not returned, we will use the best available information which will be Mr. Harcz statement to determine his continued eligibility.  I anticipate he will continue to receive benefits.
