I have not ever rented a car, but I agree with you that this may violate the law. It certainly infringes on your right to secure a vehicle and driver of your choice to travel.

We tried to rent a car this evening from National Car Rental to visit
our son in Florida in October. As Carol and I are both blind Elisabeth
would be the driver but as she does not have adequate funds we would pay
for it. 
National Car Rental absolutely refused to rent to us because someone
different than the driver would be paying. I believe this to be a
violation of the ADA.
Has anyone else had a similar experience with National Car Rental?
