Update on House Concurrent Resolution 32 (HCR 32), the ADA Education and Reform Act: What you need to know
December 8, 2016
The Senate Government Oversight & Reform Committee recently reported HCR 32 out of committee and the Ohio General Assembly is currently considering passing this measure today, during this lame-duck legislative period.
House Concurrent Resolution 32 is not a bill that would make changes in Ohio law; Rather, if passed, the Ohio General Assembly would call upon the United States Congress to take action and pass a federal law;
HCR 32 would ask the United States Congress to pass a bill called H.R. 3765, the ADA Education and Reform Act of 2015;
H.R. 3765 would make it more difficult for people with disabilities to file lawsuits when someone violates the Americans with Disabilities Act.
The bill would require a detailed and lengthy notification process that people with disabilities would have to follow before filing a lawsuit and obtaining compliance with the law.
H.R. 3765 would create barriers to the civil rights for persons with disabilities that do not exist in other civil rights laws, which would limit the power of the ADA and reduce compliance with the law.
The bill would also require federal officials to do more education and training about accessibility and public accommodations, as well as promote alternative dispute resolution methods (ways to come to an agreement without going to court) to resolve accessibility law suits.
Nearly 26 years after enactment of the ADA, there are still organizations, businesses, and companies who have yet to comply with this important civil rights law - now is not the time to add more barriers to access for persons with disabilities.
