Thank you, Joe, for your follow-up comments.  With the clarifications regarding final agency decisions offered to the Commission Board at their last meeting, it becomes even more important for the Agency provide methods and opportunities to resolve any operator hearing request in a manner permissible under promulgated rule.  While the Sheila Stelmach matter is still pending a final agency decision, the Commission will continue to act prudently regardless of the parties' inability to reach reconciliation.  

 

It is certainly not the Commission's intent to prevent, or even to appear to prevent, an individual from being properly awarded an available location.  We have no vested interest in circumventing the established award procedure.  As you are well versed in the promulgated rules and Program policies, you know they do not permit the Commission to hold a location for a specific individual.

 

The issue of temporary operator delinquency in report and payment responsibilities is also of concern to the Agency.  In mid-July, promotional agents were directed to work on resolving this issue by developing a plan for contacting these temporary operators to resolve the outstanding reports and set-aside fees.  A bi-weekly report of their progress in this matter is provided to the program manager.

I now understand why GR Justice was held back last December, but I must say that any advantage or possible opportunity for a settlement vanished when the Grayling and Kalamazoo routes were awarded.  To continue holding the GR Justice facility from the bid process at this stage gives the appearance of setting it aside for a specific person, not to mention the growing awareness of the issue of temporary operator delinquency in reporting and payments to the BEP.
