This past week, the Florida Legislature reconvened for a Special Session on gaming. This is in response to Governor DeSantis and the Seminole Tribe of Florida executing the historic new 30-year Gaming Compact that restored the State's relationship with the Tribe. 

 

In addition, Senate President Wilton Simpson lead the Senate in a declaration of support for Israel. Israel is a role model of democracy in the Middle East, and it is our moral duty to support this nation.

The Florida Senate Ratifies Historical Gaming Compact 

 

The Florida Senate passed Senate Bill 2-A, Implementation of the 2021 Gaming Compact between the Seminole Tribe of Florida and the State of Florida. The legislation ratifies the 2021 Gaming Compact executed by the Seminole Tribe of Florida and Governor DeSantis on behalf of the State of Florida on April 23, 2021, as amended on May 17, 2021.

 

“By comprehensively addressing issues raised for almost a decade, this historic legislation restores Florida’s relationship with the Seminole Tribe, offers new opportunities for Florida’s legacy pari-mutuel industry, and provides substantial new revenues for our state,” said Senate President Wilton Simpson (R-Trilby), who has been working to negotiate a new compact with the Seminole Tribe for the last several years. “After years of negotiations and the hard work of many people on both sides, I’m pleased to see this significant legislation pass the Senate today.”

 

The 2021 Compact creates a new revenue-sharing agreement with a $2.5 billion guarantee in the first five years. The Compact authorizes craps and roulette games at Seminole properties, additional facilities on the Tribe’s Hollywood Reservation, and statewide online sports betting in partnership with existing pari-mutuels.

 

SB 2-A takes effect only if the Compact is approved, or deemed approved and not voided, by the United States Department of the Interior, and takes effect on the date that notice of the effective date of the compact is published in the Federal Register.

 

The Senate also passed SB 4-A, Gaming Enforcement, which establishes additional enforcement measures to address violations of gambling laws and the conduct of unauthorized gaming in the state, including the creation of an independent five-member Gaming Control Commission. The bill also grants additional investigatory and prosecutorial authority to the Office of Statewide Prosecution in the Department of Legal Affairs.

 

SB 8-A, Gaming, updates Florida law for authorized gaming in the state, including live racing and games, slot machine gaming, and the operation of cardrooms. Specifically the bill decouples greyhound, jai alai, harness, and quarter horse racing; eliminates dormant pari-mutuel permits; and prohibits the issuance of new pari-mutuel permits.

*    Evens the playing field between out-of-state retailers and Florida’s small businesses by creating a new revenue stream to pay unemployment claims, shield employers from unexpected tax increases, and reduce business rent taxes.

*    Requires marketplace providers and out-of-state retailers without a physical presence in Florida to electronically collect and remit Florida sales tax on taxable items delivered to purchasers in Florida.

*    Only applies to out-of-state marketplace providers or out-of-state businesses whose annual sales in Florida exceed $100,000; and allows marketplaces that have annual U.S. gross sales of more than $1 billion to have a qualified marketplace seller collect and remit sales tax on the marketplace.

*    Requires that a marketplace provider, at the time of sale, must collect and remit the prepaid wireless E911 fee, the waste tire fee, and the lead-acid battery fee, on applicable sales.

*    States that businesses affected by this act will not be liable to remit taxes retroactively, however this relief does not apply to someone who has been assessed, is under audit, has received a bill, or is in court over taxes already owed.

*    Requires all revenues received from the remote sales tax under this bill to be deposited into the Unemployment Compensation Trust Fund until the balance in the trust fund reaches $4.07 billion.

*    After the distributions to the Unemployment Compensation Trust Fund are completed, additional funds collected from out-of-state retailers will go toward reducing Florida’s business rent tax rate from the current 5.5% to 2%.

*    Disables the mechanism that raises Reemployment Tax rates if the Unemployment Compensation Trust Fund balance falls below a certain limit.

*    Requires that the COVID-19 related reemployment assistance benefits paid are not taken into account when recalculating Reemployment Assistance Tax rates.

*    Authorizes refunds for businesses that paid the first calculation of the 2021 tax rates, which were inflated by COVID-19 related benefit payouts

*    One-quarter of the dollars currently directed to the Sadowski fund to be transferred into the Water Protection and Sustainability Program Trust Fund to support the wastewater grant program, which was created in the Department of Environmental Protection in Senate Bill 712 (2020).

*    Limits increases in impact fees as follows:

*    An increase to a current impact fee rate of not more than 25 percent of the current rate must be implemented over two equal annual increments beginning on the date the increased fee is adopted.

*    If the increase is between 25 and 50 percent of the current rate, the increase must be implemented in four equal installments.

*    No impact fee increase may exceed 50 percent of the current impact fee rate.

*    An impact fee may not be increased more than once every four years.

*    Provides an exception to these limits if the local government, school district, or special district demonstrates, through a study, a critical need to exceed these limits.

*    Revises impact fee credits to require any contributions made for specific infrastructure or public facility improvements to be applied on a dollar-for-dollar basis at fair market value to reduce impact fees collected for the same category.

*    Creates the Strong Families Tax Credit program to provide tax credits to taxpayers that contribute to certain family counseling charities identified and vetted by the Florida Department of Children and Families (DCF).

*    Exempts from sales tax certain items that assist in independent living.

*    Extends the property tax exemptions for educational property to include church property used for educational purposes.

The bill provides that it is a third degree felony to knowingly and willfully make a materially false or misleading statement or to knowingly and willfully disseminate false or misleading information relating to the characteristics, authenticity, effectiveness, or availability of personal protective equipment in any marketing or advertising material; on a website, social media platform, or other media; or by telephone, text message, mail, or e-mail, with the intent to obtain or receive any money or other valuable consideration.

 

The bill also provides that it is a third degree felony to knowingly and willfully make a materially false or misleading statement or to knowingly and willfully disseminate false or misleading information regarding the availability of, or access to, a vaccine for the novel coronavirus “COVID-19” or a vaccine for any other pandemic disease in any marketing or advertising material; on a website, social media platform, or other media; or by telephone, text message, mail, or e-mail, with the intent to obtain another person’s personal identification information, or to obtain or receive any money or other valuable consideration.

 

A second or subsequent violation of the previously-described offenses is a second degree felony. Prosecution for either offense may be brought on behalf of the state by any state attorney or by the statewide prosecutor. Further, if the Attorney General reasonably believes that a person has committed either offense, the Attorney General may institute a civil action for a violation or to prevent a violation. An action for relief may include a permanent or temporary injunction, a restraining order, or any other appropriate order.

 

The bill also amends the offense severity level ranking chart of the Criminal Punishment Code to rank the new offenses.

 

Governor DeSantis has until May 28, 2021 to act on these bills. State Readies Work Search Requirement 

People in Florida’s unemployment system will have to show they looked for work on a weekly basis after Memorial Day, as the state pushes to get workers back on the job.

 

Beginning on May 30th, all claimants will be required to complete work search requirements in order to continue receiving Reemployment Assistance benefits. In addition, the work registration requirement must be completed for new claimants who file after May 29.

 

Completing the Required Work Search

After Memorial Day, claimants must complete five work search contacts per week or one CareerSource service appointment. Each week, claimants will need to fill out the Work Search questionnaire in CONNECT when requesting benefit payments. Valid Work Search includes:

*    Submitting an application for work or submitting a resume to an employer

*    Applying for a job through EmployFlorida.com

*    Creating a personal user profile on a professional networking site, like LinkedIn or Indeed

*    Arranging a job interview with an employer

The Veterans Memorial Center in Brevard County is hosting Rolling Thunder and their Ride for Freedom Weekend. Veterans Council of Indian River County

 

The Veterans Council of Indian River County will be holding a Service at 9 AM on Monday, May 31, 2021, at Veterans Memorial Island Sanctuary in Vero Beach. They will be celebrating the 100th Anniversary of troops returning from World War I. They ask that you bring a lawn chair for your own comfort. In the event of rain, the ceremony will be moved to the Vero Beach High School Performing Arts Center. City of Fellsmere Memorial Day Service

 

Memorial Day is fast approaching. This holiday is dedicated to honoring the men and women who have sacrificed their lives while serving in the U.S. Military. The City of Fellsmere will be conducting a Memorial Day service to honor the sacrifices made by these brave men and women.
