Dear Director Cannon,

 

I am writing today to request under the Americans with Disabilities Act of 1990, Section 504 and Title I of the Rehabilitation Act of 1973 as amended for specific accessible information related to the following Michigan Commission for the Blind meeting:

“APPROVED AS AMENDED

 

MICHIGAN COMMISSION FOR THE BLIND

 

THURSDAY AND FRIDAY, MARCH 17 & 18, 2011”

 

As you know by now, or should know all documents related to these meetings must be made fully accessible upon request in accessible format and with no surcharge for delivery of same. I wish now to reference the following segment from this public meeting of MCB”

 

 

 

“Commissioner Scott asked for clarification on whether staff hearings cases come before Commissioners while under the appeals process, requested a transcript

of the Dave Robinson hearing and stated that the MCB legal fees paid seemed to be high.  Director Cannon clarified that the legal fees are paid on a yearly

flat rate to the Attorney General’s office.  There was also much discussion regarding the roles of the Commissioners on legal and staffing matters.  Director

Cannon explained to the Commissioners about the differences between a Type I and Type II agency and the administrative functions associated with each.”

 

 

 

 

Now, specifically I am writing to request in accessible format the entire transcript of the David Robinson Civil Service hearing.

 

Again I am blind and request this transcript as either a Word document or plain text enclosure to my e-mail address listed above.

 

Failure to respond to this request for reasonable accommodation is actionable in and of itself. Referring this to a FOIA request is an obfuscation and a violation of federal civil rights laws (ADA, 504) and would thus be a discriminatory act as well as a stalling tactic and will be promptly made yet another complaint to relevant enforcement agencies.

 

Thus, I certainly thank you in advance for your prompt and accessible response to this request.
