As much as I hate our overly litigious society, one of the biggest drawbacks
I see to the Air Carrier Access Act is, as I understand it, no ability for
victims of discrimination to file civil suits, or collect damages beyond a
certain point or for a certain type of compensation. Can't recall exactly
how that works at this point in the evening, but it seriously limits what
the airlines have to pay in terms of damages. 

Though civil rights should never be about suing for big money, the threat of
large lawsuits with deep penalties has had some effects on other public
businesses. Granted, some of these effects have been negative, but frankly,
I'd rather have them be just that tiny bit afraid they might lose their
financial shirts if they screw up.
