CMS details how to meet Medicaid work requirements

The Center for Medicaid and Medicare Services will allow affected
beneficiaries to self-declare that they met exemptions for 2027 but will

The Trump administration is giving states more time to ensure Medicaid
beneficiaries in Obamacare expansion states are exempt from impending work
requirements.

The Centers for Medicare and Medicaid Services released an interim final
rule on Monday that outlined how states can manage exemptions to work
requirements created under the 2025 One Big, Beautiful Bill Act. CMS will
allow affected beneficiaries to self-declare that they meet exemptions for
2027 but will require them to present documentation to back them up by 2028.

"This is far more than a policy prescription. This is our path to prosperity
for the American people," said CMS Administrator Mehmet Oz during a call
with reporters on Monday.

The One Big Beautiful Bill Act requires 40 states and the District of
Columbia, which expanded Medicaid under the Affordable Care Act, to
implement requirements for the expansion population starting next year.

The rule defines which beneficiaries from ages 19 to 64 must meet the
requirements.

Affected beneficiaries must complete 80 hours a month of work, training,
school or volunteering.

There are several exemptions including for pregnant women, parents of
children under 14 and people who are deemed medically frail. States can
adopt other short-term exceptions including, for example, exempting a
recipient who needs in-patient medical care.

In the guidance, CMS defines medically frail as having a special medical
need that significantly impairs the beneficiary's ability to meet the work
requirements.

For 2027, CMS is calling on states to use existing data to document whether
beneficiaries meets an exemption, including verifying medical claims that
show they have disabilities that prevent them from working. If that data is
not available, then the individual can self-declare that they have met the
exemption.

Several states have called for this approach because it is less costly for
the state and less of a burden for beneficiaries.

However, conservative health policy experts are loath to use this approach.
The influential conservative think tank Paragon Health Institute implored
CMS in an op-ed last month to avoid self-declaration, which it contends
helped fuel fraudulent signups on the Affordable Care Act's insurance
exchanges.

Oz said that the goal is to be "forgiving but not foolish" in the approach.

"We think we are appropriately going after problem areas and doing it in a
way that is compassionate and forgiving but we don't want to be fools," he
said on the call.

An adult must meet the work requirements when they apply for Medicaid
coverage or coverage renewal.

Currently only Nebraska has implemented the federal work requirements,
getting a head start back in May. Montana is expected to start its work
requirement program in July and Arkansas will do a soft launch that
implements the program the same month but doesn't drop anyone off until
January.

States are right now grappling with the costs of updating their systems to
implement the changes. Some states recently told POLITICO they are spending
tens of millions of dollars to hire new staff and pay for tech upgrades to
be ready by Jan. 1.

CMS is holding a comment period on the final rule through July 31.
