Well, the rules about who needs to have some kind of certification or licensure came from the 1998 amendments to the Act, and the subsequently re-written regulations.  The regs contain the detail about the Comprehensive System of Personnel Development, at 34 CFR Section 361.18.  The section that describes what Congress and RSA envisioned as the result of the 1998 amendments and the requirements for qualified personnel.  
Basically each of the state agencies for persons with disabilities and/or persons who are blind, had to establish a plan for anticipating the staffing needs that they would have over the course of the next 5 years.  They also had to determine what they would establish as the minimum required credentials or licensure for a person who would be providing direct service to customers.  The licensure requirements would not apply to administrative staff, supervisors, assistant supervisors, directors and assistant directors, who are still not  bound by any such requirements.  

Because the plan was to be established by the state agency serving persons with disabilities; and the minimum level of licensure or certification was also established  by that agency, it is only required for employees of the agency itself.  Perhaps an agency could decide that it wanted to hold any and all of its contractors to the same standards, but this would likely be an unwise move, because it would impact the agency's ability to contract with a number of potential direct service providers within that state.  I do not know whether any agencies have done this.
