Thank you, everybody.

I am inclined to encourage this consumer to appeal and do whatever else possible to get the services necessary. One thing that complicates matters a little bit, though, is that this consumer is still in a probationary period in his/her service with the agency, so he/she can be let go at any time without cause. I would tell him/her to wait, but the agency will go on order of selection right after his/her probation ends.

I want to feel good about both my understanding and the advice I give. Do you think it's safe to push for services while on probation?

Hi Justin,
I agree with many of the comments you have received thus far.  The wording in the original Rehab Act, was "obtain, retain, and advance in employment"
if memory serves me correctly.  There is no real reason why a blind agency can' serve one of its employees, although who serves as the rehab counselor should be an issue of concern.  I would recommend a supervisor, or anyone above the individual, do so.  If a general agency counselor needs to serve the individual, it should still be paid for by the rehab agency.

Hi everybody,

Thank you for your insights so far. If it may be useful, the client that brought this to my attention is someone who is working for an agency but has career goals a bit beyond what they are doing currently at the agency.
I guess I should call the person a "prospective client" because this person has been denied services. The person has been directed to the general agency because the Blind agency does not want to serve them because they are an employee and have confidentiality concerns, an agency which does not serve blind people, where the person has been denied, or found ineligible. It is being argued that, because the person has a job, the person does not have any impediments to employment.

Any more thoughts?

My agency simply paid for what I needed out of their budget such as reasonable accommodations, training Etc. I think that's how it should be.

Hello fellow rehab enthusiasts,

I have heard recently of a state agency serving the blind which has a practice of not allowing employees to become clients of the agency. I am told that this is because there have been confidentiality issues in the past. To me, this seems to violate the spirit of the rehab system, so I'm wondering if anyone knows if this is allowed.
